Can Government Have Unlimited Discretion to Label What is Fake, Misleading: Bombay HC

The Bombay High Court has sought clarification from the Centre regarding its authority under the new fact-checking unit (FCU) rule. Justice Gautam Patel expressed concerns over the Centre’s discretion in determining what is fake, false, or misleading. The court highlighted the ambiguity surrounding the terms and questioned the boundaries and definitions provided in the rule. The FCU rule, which falls under the Intermediary Guidelines and Digital Media Ethics Code, has been challenged by comedian Kunal Kamra. The court will continue hearing the case next Thursday.
