The Bombay high court has directed the sensitisation of police officers throughout Maharashtra on the problems faced by same-sex couples. In response to a petition filed by two women, the court has sought suggestions on potential changes to be made in the police conduct rules. The court acknowledged that incidents of harassment and discrimination are not limited to a few police stations but are pervasive across the entire state. The petitioners, fearing threats from one of their families, have been granted police protection. However, to prevent further instances of harassment, the court aims to establish guidelines in dealing with such cases. The couple’s advocate cited the Supreme Court’s ruling in the Navtej Singh Johar case, arguing that constitutional morality should take precedence over collective morality. The court also referenced the Madras HC’s judgment and subsequent orders related to same-sex couples, stressing the need for guidelines to improve the situation and prevent offences against the LGBTQIA+ community. The Bombay HC plans to study the Maharashtra rules for police conduct and suggests changes accordingly. Additionally, other departments, like education, may be involved as parties to the petition. The judges highlighted that the police department plays a crucial role in handling such cases. The hearing is set for July 28.
