The Bombay High Court (HC) expressed its displeasure at the harassment faced by medical practitioners and criticized the authorities for their misuse of power under the Pre-Conception and Pre-Natal Diagnostic Techniques Act. The court granted relief to a Nashik doctor couple and stated that the respondents in the case had clearly misused their powers. The HC quashed and set aside the complaint and consequential proceedings against radiologist Dr Chandrashekhar Gattani and his wife Dr Shruti, who works at Mayo Institute. The court noted that the complaint was filed three years after the alleged incident, which spoke volumes about the frivolous nature of the case. It emphasized the need for strict implementation of the Act but criticized the authorities for subjecting medical professionals to unnecessary harassment. The HC expected the observations to deter the authorities from acting in an arbitrary manner and did not impose costs on them. The case highlights the importance of exercising caution while dealing with such matters to avoid tarnishing the image of medical professionals and the medical profession as a whole.
