Multiple Sclerosis Patient Takes Insurer to Court for Rejecting Claim

A college lecturer from Mumbai, Manita Singh, who suffers from multiple sclerosis (MS), has moved the Bombay High Court after her private insurance company refused to reimburse her expenses for an unrelated surgery and also discontinued her family medical cover. Manita, who was diagnosed with MS in 2015, claims that insurance companies are refusing to provide her with health cover due to her condition, leading to a sense of discrimination. The lecturer’s husband accepted cashless cover from Care (formerly Religare) Health Insurance Ltd, but the claim for the surgery was rejected due to alleged non-disclosure of MS. Manita has approached the court to enforce her fundamental rights and seek renewal or a fresh policy from the insurance company. She argues that the insurance company’s conduct violates the Insurance Regulatory and Development Authority’s guidelines on covering critical illnesses like MS. Manita claims that the denial of insurance coverage to MS patients is a rampant practice and seeks the court’s intervention to protect her family from financial burdens resulting from her condition.
