The Madras High Court has rejected a writ petition filed by DMK MP S. Jagathrakshakan and his family members against proceedings initiated by the Enforcement Directorate (ED) under the Foreign Exchange Management Act (FEMA) of 1999. The court also dismissed connected writ petitions filed by the MP’s daughter, son, and a private limited company. The ED accused the MP of subscribing to 70 lakh shares of a Singapore-based company without RBI approval. The MP’s wife, daughter, and son were also accused of improper acquisition of foreign securities. The court upheld the ED’s actions and stated that the competent authority’s finding on the seizure order does not interfere with the power of adjudication of the Adjudicatory Authority.
