The US International Trade Commission (ITC) has rejected Apple’s motion for a stay pending appeal in a case involving the sales of the company’s flagship smartwatches. This comes after the ITC ruled that Apple had infringed the patents of California-based tech company Masimo. In response, Apple filed an emergency request with the US Court of Appeals for the Federal Circuit to halt the order.
However, the tech giant was able to secure a victory in court and successfully paused the commission’s ban. As a result, the Series 9 and Ultra 2 watches will be back on sale in Apple Stores and through Apple’s website on Thursday. Sales of the lower-priced Apple Watch SE, which does not have pulse-oximetry capabilities, remain unaffected.
Masimo accused Apple of stealing its pulse oximetry technology and incorporating it into Apple Watches. Masimo CEO Joe Kiani has indicated that he is willing to settle the dispute. Apple later sued Masimo, alleging that its legal actions were a maneuver to clear a path for its competing smartwatch.
The court case between Masimo and Apple is yet to be rescheduled after ending with a mistrial in May.
