The Calcutta High Court has recently ruled that all non-minority private schools in Kolkata must seek permission from the state government before enhancing fees. The decision was made in response to a petition filed by the Birla Bharati Guardians Welfare Trust, which claimed that a school had suddenly increased school fees by 48%. Justice Biswajit Basu referred to the West Bengal Right to Children to Free and Compulsory Education Rules, 2012, stating that the rule dictates that fees for students cannot be increased without the prior permission of the state government. The judge reminded the school authorities that the rule applied to all classes up to Class 8 and that they must abide by the law. The Central Board of Secondary Education (CBSE) and the Council for Indian School Certificate Examinations (CISCE) also confirmed that non-minority schools needed government permission before increasing fees. Justice Basu warned the school authorities that failing to comply with the rule could result in losing affiliation with the boards.
