The Centre on Wednesday objected to indications from the seven-judge Supreme Court bench led by Chief Justice of India DY Chandrachud that it could use the ‘legal positivist’ approach, coupled with social considerations, to decide whether Aligarh Muslim University (AMU) could regain its ‘minority character’. The bench raised the question of whether the surrendering of denominational status by AMU in 1920 could be reconsidered in the post-Constitution era. The Solicitor General argued against altering historical facts and stated that AMU voluntarily surrendered its denominational status to obtain support from the British government. The bench also questioned whether the AMU Act of 1920 can be considered completely destructive of AMU’s claim to minority status in the post-Constitution era. Arguments will resume on Tuesday.
