Enforcement Directorate opposes Arvind Kejriwal’s plea for more time with counsel

The Enforcement Directorate (ED) has opposed Chief Minister Arvind Kejriwal’s plea seeking more time with his counsel. Kejriwal, through his counsel, advocate Vivek Jain, submitted that he has 35-40 cases going on against him and one hour per week was not sufficient for a person to understand and give instructions. He argued that this is a basic legal right that he is asking for and cited the example of Sanjay Singh, who was granted three meetings when he had fewer cases. In response, the ED, represented by special counsel Zoheb Hossain, told the court that five legal meetings were against the jail manual and they were being misused for purposes other than consultation. They argued that when a person is in jail, their stature outside is irrelevant and they should be treated equally. The ED further stated that Kejriwal has already been conferred two meetings in a week and his exposure to the outside world is limited in accordance with the law. Kejriwal’s counsel argued that unequals should be treated unequally, citing Article 14 of the Constitution. He also raised concerns about the security and privacy during legal meetings. The court has reserved its order and will pronounce the judgement on April 9. On April 1, Kejriwal was sent to Tihar Jail till April 15 in the Delhi excise policy case after the ED claimed that he was noncooperative. The enforcement agency didn’t seek further remand but reserved the right to ask for further custody later.
