IPS officer G P Singh has been granted relief by the Chhattisgarh High Court, with the Division Bench staying the trial against him in an alleged extortion case taking place in the Durg court. Singh had filed a petition seeking the quashing of the trial, claiming that the case filed against him at the Supela police station in Bhilai, under Sections 384 and 388 of the Indian Penal Code (IPC), was baseless. The dispute in question originated in 2015 between Durg resident Kamal Sen and builder Singhania over a commercial transaction. During the dispute, Singhania allegedly threatened Sen by mentioning IPS GP Singh, although there was no direct conversation between them.
The lawyer representing IPS Singh, Himanshu Pandey, stated that six years later, in 2021, Kamal Sen lodged a First Information Report (FIR) at the Supela Police station in Bhilai, accusing G P Singh of demanding Rs 20 lakh from him and threatening him. Based on the complaint, a case of intimidation was registered against Singh at the Supela police station, and a trial was ongoing in the Durg court.
In an attempt to quash the FIR, IPS Singh filed a petition in the High Court. The case was heard by the Division Bench of the court, which noted that the complainant’s reporting after six years was a significant lapse of time. Additionally, it was pointed out that the necessary permission under Section 197, which is mandatory for filing a criminal case against a public servant, was not obtained. As a result, the High Court imposed a stay on the FIR.
It is worth mentioning that IPS G P Singh has faced various criminal charges during the previous regime in Chhattisgarh and has served jail time. However, the recent decision by the Central Administrative Tribunal has ordered the state government to quash all cases against Singh within four weeks and reinstate him.
