A parliamentary committee in India has suggested reducing the punishment for causing death by negligence in the proposed new criminal law. The committee, headed by BJP MP Brijlal, noted that the seven-year imprisonment prescribed for the offence was high and should be reduced to five years. In addition, the committee called for further deliberation on the recommended 10-year jail term for causing death by rash or negligent act and evading the scene or failing to report the incident. The committee observed that the punishments mentioned in the proposed Bharatiya Nyaya Sanhita were higher than those in the existing Indian Penal Code. The panel also raised concerns about the compatibility of the clause related to escaping from the incident or failing to report it with Article 20(3) of the Indian Constitution. The committee recommended limits on the application of this provision to motor vehicle accidents and the re-drafting of the clause in consultation with the Ministry of Law and Justice. The proposed laws aim to replace the Indian Penal Code, Criminal Procedure Act, and the Indian Evidence Act.
