A Division Bench of the Kerala High Court has emphasized the need to obtain permission from the State government or its authorized officer before alienating the property of an aided school. The court's decision came in response to an appeal by teachers of a lower primary school in Manjeri. The teachers challenged the government's rejection of a teacher nominated as manager by the school's purchaser. The government had justified its decision by stating that only the property owner could be appointed as manager. The court noted that under Section 6 of the Kerala Education Act, it is mandatory to seek permission from the government before alienating an aided school's property. This requirement aims to prevent haphazard property transfers that could negatively impact students' education. The Bench instructed the government to review the case under Section 6 of the Act and Rule 5A of Chapter III of the Kerala Education Rules (KER) to ensure compliance with the law.
