Thane MACT Orders Rs 28.9 Lakh Compensation for Pharmacist's Deadly Truck Crash

Thane’s Motor Accident Claims Tribunal (MACT) just served a big justice punch! The parents of a young pharmacist, aged only 29, who tragically died in a road accident in August 2020, got a handsome compensation of Rs 28.9 lakh. The grieving father (59) and mother (48) initially asked for Rs 80 lakh, but the tribunal, guarded by member R.V. Mohite, carefully checked all facts and fixed the right compensation based on the pharmacist’s income and legal rules. Here’s the shocking story: On August 1, 2020, the pharmacist was riding his motorcycle from Kalyan to Vashi. Near a hotel on Shil-Phata-Mahape Road, a big speeding truck rammed into him from behind. The crash was so bad, the truck slid about 8 feet uncontrollably after hitting the bike! The young man sadly died on the way to the hospital. Police immediately booked the truck driver for rash and negligent driving. The tribunal didn’t hold back in blaming the truck driver. It said, “The tyre marks of about 8 ft on the spot itself are sufficient to prove that the speed of the truck was out of control of the driver. The driver of the offending truck was the person who had the last opportunity to avoid the accident.” The insurance company tried to dodge paying up, claiming the driver didn’t have a valid driving licence. But the tribunal said firmly, “The insurance company has failed to prove that the driver of the offending truck was not holding a valid and effective driving licence at the time of the accident.” No escape for them! The tribunal dug into finances and found the pharmacist earned Rs 19,300 every month working at MGM Medical Store, Vashi. Using a multiplier formula (common in such cases), and adding future earning chances, loss of the family's support, and funeral costs, they arrived at the Rs 28.9 lakh figure. Out of this, Rs 10 lakh goes to the father and Rs 18.9 lakh to the mother. Some of the money must be safely put into fixed deposits. To top it all, the tribunal ordered that both the truck owner and insurance company must pay together. They have just one month to shell out the cash, which will earn 9% yearly interest from the date the parents filed the case until the full amount is paid. This verdict sends a clear warning to reckless drivers and careless insurers – justice rides fast and furious in Thane!
