Supreme Court Set to Demand Political Parties Publish Rules Online for Transparency

November 4, 2025

The Supreme Court of India is all set to shine a bright spotlight on political parties! On Monday, the court said it might soon order all political parties to publish their constitutions, rules, and regulations on their official websites. This big step comes from a plea filed by advocate Ashwini Kumar Upadhyay, who wants more transparency and honesty from political groups. A bench of three judges — Justices Surya Kant, Ujjal Bhuyan, and Joymalya Bagchi — listened carefully and said, "Unless there are very strong impediments, we would like to issue certain directions." They also told Upadhyay, who was present in court, to remind them about it during the next hearing. The court has also told Additional Solicitor General KM Nataraj, representing the Centre, that the petition raised some "meaningful prayers." The government has been asked to get instructions from the Election Commission (EC) about what to do. Upadhyay’s plea is based on a concern about "bogus political parties." According to him, these fake parties harm our democracy by giving top positions to dangerous people like criminals, kidnappers, and drug smugglers after taking large amounts of money from them. The plea mentions that there are no strict rules for political parties, so some separatist groups even form parties to collect donations and enjoy police protection. A shocking media report cited by the plea revealed that the income tax department found a "fake" political party that was turning black money into white, taking a 20% cut! It’s a big money laundering scandal right under our noses. Because political parties play a crucial public role, Upadhyay urges the EC to make strict rules to ensure they follow their own constitutions honestly and show their compliance to the court. This will bring transparency, reduce corruption, and re-energize Indian democracy. The plea also said the Supreme Court has already started many reforms to clean up public life, and regulating political parties properly will be another powerful step forward. As a backup plan, the plea asked the Law Commission of India to study how other strong democracies handle political party rules and then suggest a solid framework for India. The Supreme Court’s decision on this issue could be a game-changer for cracking down on fake political parties and making our democracy shine with transparency and justice!
