Two men jailed for gang raping three teenagers during a bucks party weekend will face a retrial. A third man was acquitted after appeals against their convictions. Maurice Hawell, 31, his younger brother Marius, 24, and Andrew David, 31, were all found guilty in 2024 after a nearly four-week joint trial. All three appealed, arguing errors were made by the trial judge and that the verdicts were unreasonable. On Monday, the court of criminal appeal quashed all convictions. Justice Belinda Rigg ordered Maurice Hawell and Andrew David to face retrial in the New South Wales district court. Marius Hawell's convictions were dismissed, and he was acquitted. Maurice had been jailed for 14 years, David for 13 years, and Marius for 9 years. During the appeal in August, lawyers claimed the jury may have misinterpreted the men’s state of mind during the incident. Tim Game SC said the evidence could have been wrongly seen as a “shared job” or “job for the lot,” leading to an unfair verdict. "It has a sinister element because it turns consensual sex into the threat of non-consensual sex and there’s absolutely nothing to support that proposition," said David’s barrister. Maurice and David will return to court on 12 December. Marius Hawks can be released immediately.
