DMK MP P. Wilson Proposes Bill for Diversity in Judicial Appointments and Regional SC Benches

DMK MP and senior advocate P. Wilson has introduced a private member Bill seeking changes to the Constitution. The Bill aims to bring social diversity into judicial appointments and create regional benches of the Supreme Court. Currently, judges of the Supreme Court and High Courts are appointed by the President after consultation, as per Articles 124 and 217 of the Constitution. Since the 1990s, a collegium system—led by the Chief Justice of India (CJI) and senior judges—oversees appointments to protect judicial independence. However, this system faces criticism for lack of transparency and alleged favoritism. Recent appointments from 2018 to 2024 show only 20% representation from Scheduled Castes, Scheduled Tribes, and Other Backward Classes. Women and religious minorities make up less than 15% and 5% respectively. Wilson's Bill mandates proportional representation of SC, ST, OBC, women, and minorities in judicial appointments based on their population share. It also sets a 90-day deadline for the government to notify collegium recommendations. To ease citizens' access and tackle over 90,000 pending Supreme Court cases, the Bill proposes setting up regional benches in New Delhi, Kolkata, Mumbai, and Chennai. These benches will hear all cases except those on constitutional importance, which will stay with the main bench in Delhi. The Bill challenges current norms and points to the need for broad-based reforms. Observers suggest reviving the National Judicial Appointments Commission with wider representation from lawmakers, bar council, and academia. This could ensure diversity and inclusiveness in judicial appointments. Establishing regional benches could begin gradually under existing constitutional powers, benefiting access to justice across India.
