Martin Antony, the second convict in the 2017 actor rape case, has filed an appeal challenging his conviction. He argued that, like actor Dileep who was acquitted, he did not commit any sexual assault and was not in the vehicle when the crime happened. In his Kerala High Court appeal, Antony’s lawyer Alex Joseph said, “When two accused persons involved in a crime are identically situated, the trial court is required to give identical treatment in appreciation of evidence for convicting/acquitting them.” Joseph added, “A lengthy, meticulous/microscopic appreciation of evidence in detail with a sole purpose for ensuring the acquittal of one and a narrow appreciation of evidence against another with the sole purpose for his conviction cannot be justified.” He demanded that Antony’s conviction and sentence be overturned. The prosecution never said that Antony and Dileep sexually assaulted the victim or were present during the assault. Antony was not in the vehicle where the rape occurred. The case against him was about conspiracy, alleging he met with other accused at Nelson’s house and helped pick the survivor in a vehicle. They also said he caused a fake accident and destroyed evidence by removing his SIM card. Antony’s appeal says the trial court ignored evidence proving his lack of involvement and connection with other accused. The appeals states there was no call or contact between Antony and the other convicts, and the trial court did not properly consider this evidence. Antony says he was falsely implicated because he was sent to pick up the survivor that day. This appeal is now before the Kerala High Court for review.
