The Supreme Court will hear a plea by the CBI against the Delhi High Court’s suspension of expelled BJP leader Kuldeep Singh Sengar's life sentence in the 2017 Unnao rape case on December 29. The Bench of Chief Justice Surya Kant, and Justices J.K. Maheshwari and Augustine George Masih is set to take up the matter. Besides the CBI, two advocates, Anjale Patel and Pooja Shilpkar, have also filed petitions opposing the high court order. On December 23, the Delhi High Court suspended Sengar’s life sentence, noting he had already served seven years and five months. The suspension applies until his appeal on conviction is decided. Sengar has challenged the December 2019 trial court verdict. However, he will remain in jail because he is also serving a 10-year sentence for the custodial death of the rape survivor’s father. The high court imposed strict conditions, including a personal bond of ₹15 lakh with three sureties of the same amount. It barred Sengar from approaching within 5 km of the survivor's home in Delhi and prohibited threatening the survivor or her mother. Any violation will lead to cancellation of bail. The Unnao rape case and related cases were moved to Delhi courts from Uttar Pradesh on Supreme Court orders dated August 1, 2019. Sengar’s appeal against his custodial death sentence is also pending, seeking suspension based on time served.
