Supreme Court: Financial Control by Husband Not Always Cruelty Without Harm

The Supreme Court has ruled that a husband's financial control over his wife does not qualify as cruelty if there is no clear mental or physical harm. A bench led by Justice B.V. Nagarathna quashed a dowry harassment case filed by a woman against her husband. The woman had said she was forced to keep a strict account of household expenses while her husband sent large sums of money to his family. She also said she had to quit her job and live as a housewife in the U.S., begging for daily expenses due to his complete financial control. She claimed pressure to lose weight after childbirth.
Justice Nagarathna said such issues reflect everyday "wear and tear of marriage" and that criminal law cannot be used for personal revenge. The court found that lack of care during pregnancy and taunts about weight "at best reflect poorly" on the husband but do not amount to cruelty justifying legal action. The woman's claim that the husband and his family demanded Rs. one crore was also dismissed for lack of evidence.
The court emphasized that claims of cruelty and harassment must be backed by specific, serious acts. Judges must carefully consider the facts in marriage cases to avoid misuse of the legal process and wrongful punishment.
