221(g) Notice Becomes Common for H-1B Visa Applicants Facing Delays in India

Immigration attorney Steven Brown says getting a 221(g) notice after the consular interview is now common for H-1B professionals in India. The slip means the State Department has not finished processing their case yet—not a refusal. Since social media vetting began on December 15, 2025, nearly all Indian applicants receive the 221(g) slip, but many get approval within days. Visa officers review applicants' social media before making a decision, causing this standard delay. If the delay extends to weeks or months, applicants can ask the consulate for updates or consider legal action. However, Brown cautions that lawsuits do not guarantee visa approval and take time. The 221(g) notice can also ask for extra documents from applicants or employers. To avoid delays, applicants should bring all important papers like H-1B approval (I-797), job letters, pay stubs, tax returns, and petition paperwork. They should prepare to explain their job details and ensure the DS-160 form is fully completed. Employers should be ready for possible consulate queries. This checklist may speed up the process and reduce wait times.
