Texas AG Probes H-1B Firms Amid Abuse Claims; Immigration Lawyer Backs Detailed Investigation

Texas Attorney General Ken Paxton has ordered an investigation into three H-1B visa firms following claims by journalist Sara Gonzales. Gonzales alleged these firms, two being Indian-origin companies, have no real offices or employees, using only empty or residential addresses. Critics call this typical of some H-1B staffing firms, known as bodyshops, which supply workers but do not have their own operations.
The Texas AG seeks details about each firm's employees and their products or services to verify these claims. Immigration attorney Chand Parvathaneni, recently noted in the news for refuting a false claim of filing 700,000 H-1B applications, welcomed the investigation. He said, "bad actors should be punished but a few bad actors do not represent those who follow the law."
He explained, "As immigration attorneys, we do not have financial or ownership interests in any of our client companies. We do not guarantee approvals, and our work and fees remain the same regardless of whether a case is approved or denied. Our role is limited to preparing and filing petitions based on information provided by employers."
Parvathaneni further stated, "We do not control client companies, nor do we have visibility into their day-to-day operations. Employers operate independently, and compliance ultimately rests with them. The government has the tools, authority, and resources to audit companies, review operations, verify LCA compliance, confirm wage payments, and examine financial records. Thorough investigations protect due process, identify fraud where it exists, and preserve the integrity of the H-1B program."
He also noted that "current H-1B regulations were written in the 1990s and do not fully reflect today’s workforce realities or the impact to US workforce and needs a reform. Government investigations, not social-media accusations, are the appropriate way to isolate violations and ensure accountability by finding the real culprits."
