Ministry Forms Expert Panel to Tackle Transgender Healthcare Issues After Supreme Court Directive

The Ministry of Social Justice and Empowerment has created a panel of medical experts to discuss and guide health policies for transgender persons. This move follows an earlier advisory committee formed after the Supreme Court’s direction in the Jane Kaushik vs Union of India case. Jane Kaushik, a transwoman, claimed she was discriminated against and fired by schools in Uttar Pradesh and Gujarat due to her gender identity. The Ministry's directive pointed out that the earlier advisory meetings lacked representation from the Union Health Ministry. Health services are crucial and need special attention for transgender people because their medical needs differ from males and females owing to hormonal, physiological, and psychological differences. A combined meeting of medical experts and the advisory committee is planned for February 2, 2026. Gopi Shankar Madurai, a representative of intersex persons and former National Council member, stressed the importance of including the Health Ministry. Madurai said, “While transgender individuals deserve dignity and rights, policies must be grounded in biological sex distinctions to protect all vulnerable groups. I urge ICMR, AIIMS, and the government to fund peer-reviewed, longitudinal studies on GAS/HRT outcomes, integrate genetic counselling, and reform prison policies for separate transgender facilities.” They added, “This science-based approach will mitigate suffering, align with ethical imperatives, and foster a truly equitable society.”
