Judge Clears Way to Release Evidence in Chicago Border Patrol Shooting Case

A federal judge on Friday allowed Chicago woman Marimar Martinez to publicly release key evidence from her Border Patrol shooting case. This includes text messages, body camera footage, photos, and FBI reports. US District Judge Georgia Alexakis said these materials show the agent’s mindset and how the Department of Homeland Security (DHS) reacted after the October 4 incident. Among the texts are messages from agent Charles Exum boasting about the shooting. In one text, he wrote: “I fired 5 rounds and she had 7 holes. Put that in your book, boys.” DHS lawyers argued releasing the evidence could harm Exum and his family. But the judge said Martinez, wrongly called a “domestic terrorist,” deserves to clear her name. Martinez was shot five times after a crash between her car and federal agents’ vehicles in Chicago. She denies ramming their cars and says the agents were the attackers. Exum’s body camera was off, but other agents’ footage and Martinez’s 911 call show the chaos. Federal charges against Martinez were dropped with prejudice, yet officials and social media still portrayed her as a threat. The judge also allowed the release of vehicle tracking images and surveillance photos, which could help the public and officials understand DHS’s use of deadly force. Martinez’s lawyer said the evidence will expose the “counter-factual PR campaign” against her and reveal the real story.
