Supreme Court Overturns HC Stay on Shifting Himachal OBC Commission to Dharamshala

On February 9, 2026, the Supreme Court set aside the Himachal Pradesh High Court's interim order that had paused the State government's move to shift the OBC Commission from Shimla to Dharamshala. A Bench led by Chief Justice Surya Kant said such decisions are policy matters and normally not for judicial interference. The court noted that OBC populations generally live in Kangra and nearby areas, so shifting the Commission is often in public interest. However, the Supreme Court allowed the High Court to hear the case after the State government submits a reply within four weeks. Earlier, the High Court had stayed the move on January 9, after a PIL by Ram Lal Sharma challenged relocating the Commission's headquarters to Dharamshala while keeping Shimla as a camp office. The Supreme Court clarified its remarks concerned only the interim order and would not affect the final outcome.
