Supreme Court Rejects Plea to Bar Hindu Pujas at Waqf Property in Karnataka

The Supreme Court on Thursday (February 12, 2026) refused to hear a plea asking to stop Hindu pujas at Raghav Chaitanya (Shivalinga) inside Hazrath Ladle Mashaq Dargah in Aland town, Kalaburagi district. The court said Article 32 of the Constitution was not applicable here. The petition was dismissed as withdrawn. The plea was filed by Khaleel Ansari, secretary of the Dargah’s managing committee, who argued the property is declared a Waqf by the Waqf Tribunal.
Despite this status, third parties approached the Karnataka High Court seeking permission for pujas on occasions like Maha Shivratri on February 15. The High Court gave ad hoc orders allowing rituals. The petitioner said these orders violated the Places of Worship (Special Provisions) Act, 1991, and changed the religious nature of the site.
The petitioner asked for a direction to protect the site’s Waqf status and stop any orders permitting entry, puja, inspection, or changes to the property while appeals are ongoing. Senior advocate Vibha Datta Makhija said the matter should not be reopened since the Waqf Tribunal’s decision is final. She added yearly petitions seeking ritual permissions disrupt the managing committee’s rights under Article 26.
The Supreme Court Bench, led by Justices Dipankar Datta and S.C. Sharma, declined to hear the plea under Article 32. Justice Datta said, "Article 32 was not designed to be invoked merely because certain orders had been passed by a High Court." He added that unless it is a pan-India issue, the proper remedy lies elsewhere. The court also said that declaring Waqf status falls under the Waqf Tribunal’s role. The request to link this case with others under the Places of Worship Act was denied.
The petition was formally dismissed as withdrawn on February 12. This means the Hindu pujas will continue as per High Court permissions, but ongoing appeals about the site’s Waqf status remain unresolved.
