The Supreme Court has asked Justice (retired) Aniruddha Bose, Director of the National Judicial Academy, to create guidelines to help judges show more sensitivity and compassion in sexual assault cases, especially involving minors. The decision came after a High Court judge used explicit language when describing a sexual assault on a minor girl in his order. A three-judge Bench led by Chief Justice of India Surya Kant directed Justice Bose to include legal experts, academics, and social workers in the committee preparing the report. The court stressed that the guidelines should be simple, without legal jargon, so victims can understand. "There is no point to such an exercise if the victims, whose rights the exercise seeks to protect, did not understand a word of the report," the court said. It also asked for the report to be translated into regional languages. The court noted that many offensive words in local languages are commonly used but are punishable under law. The judgment stated, "It shall be highly appreciated if the committee...is able to identify and compile such words/expressions, from different languages, so that they do not go unnoticed, and the complainants/victims are empowered to give a better and fuller narrative of the trauma undergone by them." This move was triggered by a petition from the NGO 'We the Women of India' and senior advocates, following a controversial March 17, 2025, order by a Single Judge Bench of the Allahabad High Court. That order described the sexual assault in explicit terms and downgraded charges against two accused men from "attempt to rape" under the POCSO Act to a lesser offence. The Supreme Court strongly criticized this, saying judges must have compassion and understand the realities faced by vulnerable victims. Chief Justice Kant said, "Our decisions... must reflect the ethos of compassion, humanity, and understanding, which are essential for creating a fair and effective justice system." The Supreme Court set aside the Allahabad High Court's March 2025 order and restored the earlier summons by the Special Judge dated June 2023 against the accused men under the POCSO Act.
