The Supreme Court has spoken loud and clear: the government cannot just watch silently while lakhs of homebuyers suffer because their dream homes remain unfinished! These families keep paying EMIs but live with endless stress as their houses turn into cold, unfinished structures. The court called this a violation of a fundamental right – a home is not just a building, it’s part of the right to life. A bench of Justices J B Pardiwala and R Mahadevan made it clear that the state has a constitutional duty to stop people’s dreams from becoming nightmares. How? By actively stepping in to help stalled housing projects. One spicy idea the court tossed up is to create a special revival fund. This fund could be set up under the National Asset Reconstruction Company Ltd (NARCL) or by expanding the already existing SWAMIH Fund. The goal? To give quick financial support to projects stuck in insolvency processes so they don’t get crushed and leave homebuyers empty-handed. The judges warned, "Every rupee in the SWAMIH Fund must be used strictly for last-mile financing, and a tough audit by the CAG must keep an eye to stop misuse." But that’s not all! The court insisted the government build a strong shield to block greedy developers from cheating buyers. It said, "Ensuring timely project completion must be a cornerstone of India's urban policy." It also threw light on the 'cash economy' and speculation that push housing prices unfairly high, harming honest end-users. With many real estate projects drowning in insolvency, the court also suggested a bold move — setting up a government-backed body (maybe like NARCL) or a partnership with construction-focused public companies to identify, take over, and finish these stuck projects. The bench tugged at heartstrings saying, "For many middle-class people who’ve invested their life savings, the pain is huge. They face EMIs, pay rent, and still see unfinished buildings where their home should be. Some projects haven’t even started despite full or big payments!" In the end, the Supreme Court’s message is crystal clear: the government must protect homebuyers’ hard-earned money and dreams. It’s time to turn those endless waits into keys in hands and hopes fulfilled.
