Law Commission: Simultaneous Polls Amendment Need Not Be Ratified by States

The Law Commission has informed a joint committee of Parliament that the Constitution amendment bill aiming to allow simultaneous polls does not need ratification by half of the states. According to the commission, the bill falls under Parliament’s law-making powers which do not require state approval. This was stated in a brief opinion given to the committee on November 28, following a detailed opinion in October. The committee is examining bills for holding Lok Sabha and state assembly polls together. The Law Commission said, "the proposed amendment does not disturb the basic structure of the Constitution in any way." It also clarified, "any curtailment of the term of the House(s) by the proposed amendment does not violate the basic structure of the Constitution." On federalism, the commission emphasized that India’s system does not separate units completely but integrates them with a strong Centre as the core. Justice Dinesh Maheshwari and other commission officials will brief the committee on December 4, 2025.
