Supreme Court Flags Risks of Generative AI in Judicial Work, Stresses Human Control

The Supreme Court on Friday stated it is very alert to the dangers of blind use of Generative Artificial Intelligence (GenAI) in courts. Chief Justice of India Surya Kant said, "We are very conscious, in fact, over conscious. We do not want Artificial Intelligence overpower the judicial administration process." This came during the hearing of a petition by Kartikeya Rawal, who raised alarms over GenAI creating false judgments and biased content. The petitioner’s lawyers pointed out that some lower courts referenced fake Supreme Court rulings, warning about AI errors "hallucinations." The Chief Justice responded, "let that be a lesson to the Bar to verify everything they research on. The judicial officers also have an equal responsibility to verify." He added that training camps for judges address AI challenges. The petition asked for strict rules on GenAI use in courts until a formal law is made, citing concerns about transparency, data bias, and fake case laws. It warned that GenAI can generate fake legal content and bias by using advanced neural networks without proper oversight. The Court allowed the petitioner to withdraw but encouraged suggestions through administrative routes. The focus remains clear: AI must not replace human judgement in India’s judiciary.
