Supreme Court Questions Election Commission's Power in Electoral Roll Revision

The Supreme Court will continue hearings on December 11, 2025, over petitions challenging the Election Commission of India's (ECI) decision to conduct a special intensive revision (SIR) of electoral rolls in several states, including Bihar. On December 9, the court raised important questions about the scope of the ECI's power. The Bench asked, “Can the ECI adopt an inquisitorial approach to determine whether a person is a citizen by requesting documents? Or is its power of supervision limited to verifying the age and residence of an elector?” Senior advocates Shadan Farasat and P C Sen, among others, presented arguments on behalf of petitioners opposing the SIR process. The Supreme Court emphasized that the powers of the Election Commission under Article 324 must align with constitutional standards of fairness and equality as stated in Article 14. The hearing is set to continue, reflecting the court's careful scrutiny of the limits of the ECI's authority in revising electoral lists.
