Supreme Court stays Kerala High Court order on Munambam Waqf property registration

On December 12, 2025, the Supreme Court stayed the Kerala High Court order that struck down the registration of the Munambam holding as a Waqf property. The court ordered status quo on the disputed 404-acre land. A Bench of Justices Manoj Misra and Ujjal Bhuyan clarified it did not stay the High Court’s direction to maintain an inquiry commission appointed to examine ownership of the land.
The Supreme Court acted on a petition by Kerala Waqf Samrakshana Vedhi challenging the High Court's October 10 order. The Vedhi argued that the Division Bench's decision violated statutory finality since the validity of the Waqf declaration falls under the exclusive jurisdiction of the Waqf Tribunal. They said the High Court overstepped by ruling on the property’s status in a writ petition, bypassing the proper legal procedures, especially with the matter pending before the Waqf Tribunal.
The Kerala government had set up a commission led by Justice C.N. Ramachandran Nair, former acting Chief Justice of Kerala High Court, in November 2024 to investigate land ownership in Munambam. The Supreme Court has also issued notice to the Kerala government and requested its response to the Vedhi’s plea. The mandate to ascertain the property ownership and status continues amid this legal tussle.
