Kerala Resident Faces New Court Contempt Petition for Refusing to Vacate Apartment

The Chander Kunj Army Towers Apartment Owners Association (CATAOA) has filed a contempt of court petition in the Kerala High Court. This petition targets one apartment owner who refuses to leave his flat. All other 207 owners have already moved out. The flats are marked for demolition and reconstruction following a court order.
The petition was filed before the same bench where apartment owner Ciby George had earlier filed a contempt petition against the district collector. Mr. George lives in apartment number 101 in Tower C and had accused the collector of not following court orders on evacuation and demolition.
In August, the court upheld the demolition order due to serious structural issues finding the twin towers unsafe. The Collector's committee is supposed to pay affected owners six months’ advance rent and relocation charges using funds from the Army Welfare Housing Organisation.
Owners in Tower C should get ₹35,000 per month as advance rent, ₹30,000 for Tower B, and ₹30,000 as relocation charges.
Mr. George, a retired army colonel, still lives in his apartment. He says he hasn’t received the advance rent and relocation charges. But CATAOA officials say Mr. George has been paid three months of rent from the escrow account. They believe the remaining amount was cut since he stayed in the flat.
CATAOA says they are worried for Mr. George’s safety. Recently, a large piece of concrete fell from the ceiling in Tower C's lobby. They also say his refusal to vacate delays the project. Utilities and maintenance now only serve him but cost all residents.
Mr. George confirms he received ₹1.05 lakh but says he does not know if it’s rent or compensation. He demands full payment before leaving. He denies delaying the project, saying demolition contractors have not been finalized yet.
He states, "I will move out the moment I am paid the advance rent and relocation charges."
