Ernakulam Commission Fines Contractor ₹1.10 Lakh for Not Completing Houses

The Ernakulam District Consumer Disputes Redressal Commission fined a contractor ₹1.10 lakh for failing to complete two houses as promised. The case was filed by Ouseph George of Aluva against contractor Shijo Yohannan. On November 1, 2017, Ouseph and Shijo agreed for building two houses. Despite payments of ₹9,30,900, the contractor stopped work on August 12, 2018, before finishing the project. The complainant said sub-standard materials were used and defects appeared. He had to spend about ₹2 lakh more to fix the problems. The complainant also took a loan for the houses and kept paying EMIs. The contractor denied the claims, saying he got only half the daily labour fees and had completed 99% of work, which the complainant obstructed. But a court-appointed commissioner reported the work was incomplete and no construction was ongoing. The Commission noted the contractor did not submit written arguments. It ruled abandoning the work after full payment was a clear deficiency in service. Using poor materials and poor work were called negligence. The claim that 99% work was done was disproved by the commissioner’s report. There was no proof that the complainant blocked work. The Commission ordered the contractor to pay ₹1 lakh as compensation for service failure and unfair trade practice plus ₹10,000 for court costs.
