Bombay High Court Grants Bail to Activists in Elgar Parishad Maoist Case

The Bombay High Court on January 23, 2026, granted bail to activists Sagar Gorkhe and Ramesh Gaichor in the Elgar Parishad Maoist links case. Both were arrested in September 2020 and are currently in Taloja prison. The court noted that since other accused have been released on bail, Gorkhe and Gaichor also deserve bail on the grounds of parity. A Bench led by Justice A.S. Gadkari highlighted their long incarceration and the delay in the trial's start. The activists must furnish a bail bond of ₹1 lakh each and report monthly to the National Investigation Agency (NIA).
The case involves around 16 accused, including lawyers, activists, and academics, linked to alleged provocative speeches at the Elgar Parishad event in Pune on December 31, 2017. The police say these speeches led to violence at Koregaon-Bhima the next day. The initial probe was by Pune police, who claimed Maoist backing for the conclave. Later, the NIA took over the investigation. All accused, except Surendra Gadling, have been granted bail. Notably, Father Stan Swamy, an 84-year-old tribal rights activist, died in custody in July 2021 while awaiting trial. Other accused include Varavara Rao, Sudha Bharadwaj, Anand Teltumbde, and others.
