Gauhati HC Takes Up PIL Over Alleged Voter Objection Misuse in Assam Assembly Poll Prep

Guwahati: The Gauhati High Court on January 28, 2026, listed a Public Interest Litigation (PIL) seeking investigation into alleged large-scale misuse of voter objections in Assam's Special Revision of electoral rolls. The PIL, filed by advocate F.Z. Mazumder, claims false and fraudulent Form-7 objection filings before the 2026 Assembly polls. The petition alleges impersonation, identity misuse, and lack of action by election and state authorities. Mazumder called for a high-level independent judicial inquiry to stop deletion of valid voters based on forged complaints. The PIL cited media reports of voters wrongly marked as dead or shifted, with some denying they filed objections. The petitioner warned this threatens free and fair elections and hurts marginalized voters the most. The court directed replies from the Centre, Assam Government, Election Commission of India, and State Electoral Officer by February 24. Meanwhile, the Assam unit of Trinamool Congress objected to Chief Minister Himanta Biswa Sarma’s remarks on "vote theft" during the revision process. TMC’s Dulu Ahmed wrote to the Chief Justice, saying Sarma admitted irregularities but took no action. Ahmed also condemned Sarma’s use of "Miya," a term for Bengali-speaking Muslims seen as derogatory, and urged the court to prevent communal incitement in election matters. The draft electoral roll published December 27, 2025, lists 2.51 crore voters after marking 4.78 lakh dead, 5.23 lakh shifted, and deleting 53,619 multiple entries. Authorities claim 100% verification in over 61 lakh households. On January 25, six opposition parties submitted a memorandum alleging legal violations, political interference, and harassment in the revision process, calling it "arbitrary, unlawful, and unconstitutional."
