PIL Filed in Madras HC Against Key Provisions of New VB-G RAM G Act Replacing MGNREGA

A public interest litigation (PIL) has been filed in the Madras High Court against eight provisions of the Viksit Bharat - Guarantee for Rozgar and Ajeevika Mission (Gramin) Act (VB-G RAM G Act) of 2025. This new Act replaced the Mahatma Gandhi National Rural Employment Guarantee Act (MGNREGA) of 2005. The PIL will be heard soon before Chief Justice Manindra Mohan Shrivastava and Justice G. Arul Murugan.
The petitioner, 71-year-old advocate T. Sivagnanasambandan from Chennai, through his lawyer M.L. Ravi, stated that MGNREGA was one of the world's largest social security programs. It greatly helped weaker sections, backed by studies. However, the new Act shifts the Centre-State financial burden ratio from 90:10 to 60:40 for most states except North Eastern and Himalayan states.
Sivagnanasambandan also criticized the removal of autonomy granted to village panchayats under MGNREGA according to the 73rd Constitutional amendment. He warned that dismantling MGNREGA could cause catastrophic effects on millions living in rural India.
The PIL challenges Sections 3(1), 4(5), 5(1), 6(2), 22, 30, 34, and 37 of the VB-G RAM G Act as unconstitutional and anti-federal. These sections regulate State schemes, Centre’s control over work allocation, work guarantees, restrictions during peak agricultural seasons, altered Centre-State funding shares, limits on State financial aid, strict State rule-making limits, and repeal of MGNREGA laws.
The petitioner asked the court to declare these eight provisions null and void to protect the rights under Articles 14, 16, and 21 of the Constitution. The matter is expected to be listed for hearing during the week.
