Santos Wins Landmark Greenwashing Case Against Misleading Net Zero Claims
February 17, 2026
Gas company Santos has won a major court fight against accusations of greenwashing. The Australasian Centre for Corporate Responsibility (ACCR) claimed Santos misled investors by calling natural gas "clean energy" and promising a clear path to net zero by 2040. The federal court dismissed the case on Tuesday, saying Santos’s statements were not deceptive. Santos said its climate targets were "a statement of present intention" and not a promise. Justice Brigitte Markovic ordered ACCR to pay Santos’s costs. The detailed reasons will be released on 23 February. ACCR’s co-chief Brynn O’Brien said they were disappointed but ready to study the complex ruling. She called it a “David versus Goliath battle” and said the case highlighted how Santos’s green claims helped secure market advantage. O’Brien stressed the case aimed to protect market truth and investor clarity, not to punish climate ambition. Santos has not yet commented on the verdict.
