Islamabad High Court Questions Domestic Violence Act as Lahore Court Convicts Man for Assault

The Islamabad High Court on Wednesday issued notices to the Ministry of Law and Justice and the Ministry of Human Rights. This came after a petition challenged the Domestic Violence (Prevention and Protection) Act, 2026. Justice Arbab Muhammad Tahir heard the case filed by Advocate Abdul Wahab Farid. Petitioner’s counsel Maham Fatima and Sardar Tariq Hussain argued that the law breaks parts of the Constitution, including Articles 4, 8, 10-A, 35, and 227. They said the law violates fundamental rights, is against Islamic rules, and denies a fair trial as guaranteed by Article 10-A. They also said some sections give too much power that might be abused. After the first hearing, the court asked the ministries to reply and postponed the next hearing. Meanwhile, in Lahore, a model criminal court convicted a man for assaulting his wife and mother-in-law. The case dates back to April 2, 2021. The husband abused his wife after pushing her to find a job, which she refused. He and family members beat her, leading her mother and brother to come to help. The husband then assaulted his mother-in-law, tearing her clothes and beating her till she lost consciousness. Neighbors rescued the victims. The wife stayed at her parents' home for eight months and got medical treatment. The defence claimed the case was false and said no medical reports were filed, but police said Covid-19 disrupted procedures. The court found the man guilty under Section 354 of the Pakistan Penal Code. He got three months’ rigorous imprisonment and a Rs1,500 fine for each assault. The husband now faces six months in jail and Rs3,000 in fines. The judgement was announced on Tuesday by Judicial Magistrate Hamidul Rahman Nasir.
