The Madras High Court has ordered YouTube to block a video review of a water energiser. The court said YouTubers cannot damage a company’s reputation under the guise of product reviews. Justice N. Senthilkumar granted an interim injunction against the YouTube channel ‘Buying Facts’. The channel reportedly run by Syed Imran and Syed Abbas from Chennai was told to stop circulating the video. The case was filed by Theni-based Nannir Water Source LLP. They accused the channel of trademark infringement, disparagement, and defamation. Their lawyer, Ramesh Ganapathy, said the video created false doubts about their product’s effectiveness. The court agreed, pointing that such acts violate the company’s business rights under Article 19(1)(g) of the Constitution. “The first respondent’s defamatory and disparaging conduct would not only injure the applicant’s reputation and goodwill but would also adversely affect the applicant’s business prospects and commercial standing in the market,” the judge noted. Nannir Water Source LLP manufactures eco-friendly, electricity-free water treatment systems for homes, industries, and farms. They registered their trademark in 2022 and got a certificate in 2023. However, a video posted by ‘Buying Facts’ on May 25 made misleading statements about the product. This, the company said, could make customers hesitate to buy it and cause them huge losses. Ganapathy cited a similar case where the Bombay High Court granted an interim injunction for Marico Limited regarding Parachute coconut oil. This shows how seriously courts treat such reputation risks.
