Karnataka High Court Denies Bail in Byrathi Basavaraj-Linked Murder Case, Approves Custody Extension

The Karnataka High Court has rejected bail pleas from five accused in the murder of realtor Shivaprakash alias Bikla Shiva, killed on July 15. The accused claimed a procedural error in extending their judicial custody beyond 90 days. Justice S. Sunil Dutt Yadav found no procedural lapse in allowing 45 more days for the police to submit the final investigation report. The Criminal Investigation Department (CID) invoked the Karnataka Control of Organized Crime Act (KCOCA) for the probe, which permits up to 90 days extension for final reports.
The accused who filed bail petitions include K. Kiran (accused-2), Vimal Raj B. (accused-3), Pradeep (accused-6), Madan R. (accused-7), and V. Samuel (accused-8). The court dismissed their argument that the public prosecutor failed to attach the investigating officer's report when seeking the extension. Justice Yadav stated, "absence of annexing the report of the investigating officer would not denude the legal value to be attached to the report of the public prosecutor."
The High Court confirmed the public prosecutor’s report met KCOCA requirements by detailing the investigation progress and the need for extending detention beyond 90 days. The murder probe under KCOCA involves all accused, including MLA Byrathi Basavaraj.
