Contempt Petition Filed Against Ernakulam Collector Over Delay in Chander Kunj Towers Evacuation

A resident of the Chander Kunj Army Towers in Kochi has moved a contempt of court petition against Ernakulam District Collector G. Priyanka. The complaint alleges that the Collector failed to follow a Kerala High Court order to evacuate, demolish, and rebuild the twin towers due to serious structural issues.
The high court had earlier ordered demolition after a writ appeal was dismissed. The Collector chairs the committee responsible for carrying out this judgment.
Retired Army Colonel Ciby George, who lives in Tower C, said the Collector did not evacuate the building as directed. He is the only one still living there among 208 affected apartments because he was denied advance rent and relocation charges promised by the court.
The September 10, 2025, judgment mandates six months of advance rent—₹35,000 per month for Tower C owners, ₹30,000 for Tower B, plus ₹30,000 relocation charges. These funds are to be held in an escrow account by the Collector, with payments credited by the Army Welfare Housing Organisation (AWHO).
Others moved out after AWHO deposited the rent into the escrow account, but Mr. George was left out. After noticing this on October 14, the Collector ordered AWHO to pay him immediately, noting the Resident Welfare Association had excluded his name.
The petition states, "As per the judgment, it is directed that the respondent (the Collector) shall finalise the buy-back scheme and carry out a comprehensive exercise to re-evaluate and reassess the scale of construction within a set time frame. It is also directed that the timeline set by the respondent shall be scrupulously adhered to. However, the respondent has failed to implement these directions. As a result, owners who have opted for buy-back to exit the project have been paid rent and continue to consume project funds without any reasonable cause, while this petitioner has been denied rent. Due to the delay in finalising the buy-back scheme, implementing the judgment, and repossessing the petitioner’s apartment, the process has been delayed."
The Kerala High Court will hear the contempt petition on December 18.
