Man Acquitted After 8 Years in Jail in Mumbai Sexual Assault Case Due to Scanty Evidence

A 56-year-old man was acquitted by a Mumbai court after spending eight years in prison for an alleged sexual assault. The special court for Protection of Children from Sexual Offences Act (POCSO Act) found the evidence "scanty" and contradictory. The case dated back to August 23, 2017, in Kurar, Malad (East). The man, a neighbour of the victim, was accused of entering her house and sexually assaulting her. The victim was said to have a moderate intellectual disability and was claimed to be 17 years old at the time. The victim’s statement clashed with medical evidence and lacked detailed description of the incident. Judge N.D. Khose ruled the prosecution failed to prove the man’s guilt beyond reasonable doubt. The judge ordered, “The accused should be released forthwith if not wanted in any other case.”
