On February 6, 2026, the Supreme Court allowed the medical termination of a 30-week-old pregnancy of a minor. The court said, “a person cannot be compelled to carry her pregnancy to its full term.” The Bench of Justices B.V. Nagarathna and Ujjal Bhuyan noted the minor was facing an "unfortunate situation" because of an illegitimate pregnancy. They stressed the importance of a woman's right to reproductive autonomy. The court said, "If the interest of the mother is to be taken note of, then her reproductive autonomy must be given sufficient emphasis. The court cannot compel any woman, much less a minor, to complete her pregnancy if she is otherwise not intending to do so." The Bench also expressed concern about women seeking dangerous abortions from unqualified providers if their pregnancy passes the 24-week limit under the Medical Termination of Pregnancy (MTP) Act, 1971. This ruling highlights the Supreme Court's support for protecting the rights and health of women and minors in difficult pregnancy cases.
