Delhi High Court has imposed a cost of Rs 25,000 on a man for seeking the registration of a fake rape case against his wife’s cousin. The allegations made by the husband were denied by his wife. The court dismissed the petition, stating that it lacked merit and that frivolous complaints should not clog the criminal justice system. The court emphasized that such complaints can be a form of harassment for both the spouse and anyone who may be innocently framed and prosecuted. The husband had challenged two court orders that refused to direct the registration of an FIR against the cousin. The court noted that the wife had no grievances and had denied the incident of rape. The court further explained that just because the wife had disclosed information about the alleged offence to the husband, it does not give rise to a cause of action if she categorically denies it. The husband had claimed that his wife disclosed after a few days of their marriage that she was raped by her cousin and that her mother had threatened her not to disclose it. However, the wife refuted these claims before the trial court, stating that her husband was physically harassing her and demanding dowry. The court highlighted that proceedings regarding domestic violence, maintenance, and divorce were already pending between the parties.
